What is an Industrial Design?
What does design refer to?
Design
refers to features of shape, configuration, pattern or ornament applied
to an article by an industrial process. It is about the aesthetic aspect
of an articles design, not its functional aspect. A Registered Design
is protected in its eye appeal, not in its functionality or construction.
A design
is registered in respect of any article of manufacture, including parts
or sets of articles. Only designs which are new may be registered.
The registered
owner of a design has the exclusive right with respect to any article
for which the design is registered and on which the design is applied,
to exploit the article for commercial gain.
The registered
design is personal property which can be assigned, transmitted or licensed
to others like any other personal property.
Protection
begins from the date of filing the application. It will last for an initial
period of 5 years, with renewal possible for 2 further periods of 5 years
each.
Guidelines for Registration
Application Process for Industrial Design Registration
- Submission of IPOS
Form D3 and official fee of S$220 per design.
- Examination by
Registry to determine if the Formal Requirements are satisfied.
- Correction of any
non-compliance within specified time period.
- Publication of
a notice of registration in the Gazette.
- Registration is
recorded in the Register and issuance of a certificate.
- Publication in
the Designs Journal.
Note: The registration
is valid for 5 years from date of filing, and is renewable twice for 5
year periods, for a total of 15 years maximum.
Design Filing Requirements
- Classification
of the article or set of articles.
- Number of articles
in the set, if application is for a set of articles.
- Type of article(s)
or set of articles to which the design applies.
- The applicant's
right to the design, if he is not the designer.
- ame and address
of applicant.
- Kind of incorporation
or constitution type of company, and country or state.
- Particulars, with
certificate, of the basic application for a Claim to Priority in a Convention
country, if any. (Within 6 months)
- Application or
Registration number(s) of an earlier associated design, if any.
- Circumstances of
disclosure if the design(s) has/have been previously disclosed.
- Three identical
representations of the design per article, within a box 13cm x 15cm;
Either a drawing or photograph, suitable for reproduction.
- A statement of
novelty, about the features considered new. (Except for textile, lace,
wallpaper).
- Statement with
respect to previous registration, if any, in respect of other articles,
under Section 10 of the Designs Act 2000.
- IPOS Form D3 and
Official Fees.
